Unfair dismissal claims are by far the most common claims that are seen in the Employment Tribunals of England and Wales.
In order to succeed with an unfair dismissal claim, an employee needs to show that the termination of his or her employment falls outside of the band of reasonable responses. This can be because the employer’s process which was followed prior to the dismissal was flawed or alternatively, where the dismissal itself was substantively unfair.
In the event an employee believes that his or her redundancy is either procedurally or substantively unfair, that person has the right to issue a claim of unfair dismissal at the Employment Tribunal. This claim should be issued within three months of the date of the termination of his or her employment for the reason of redundancy.
In order to prove a claim for discrimination, one must show that they have been treated less favourably than a comparator for a prohibited reason or on a prohibited ground.
