Rooney Family Law
As our name suggests, we only practice Family Law. This is because we believe that when dealing with such important issues which affect you, your child / children and / or your financial future you deserve to know that the solicitor you choose lives and breathes that area of law every day. We are unaffected by the influence of other departments and pressures, allowing us to focus on the Family Law issues you are facing.

We are experts in Family Law. Our Lawyers are accredited as Specialists in Family Law by the Law Society. Our Paralegals are also accredited by the Law Society. The Law Society says 'Accreditation acts as a hallmark of experience that a client can trust'. We use that experience to assist you with your case and to help you achieve the best possible outcome.

Our family divorce lawyers & solicitors are unique in that we charge our fees on actual time i.e. 2-minute call charged as a 2-minute call) whereas the vast majority of solicitors charge in units where all work is rounded up in 6 minute units (so a 2 minute call is charged at 6 minutes, 7 minute meeting charged as 12 minutes).
Services
As our name suggests, we only practice Family Law and are an Accredited Family Law Specialist.
This is because we believe that when dealing with such important issues which affect you, your child/children and/or your financial future you deserve to know that the solicitor you choose lives and breathes that area of law every day.
We are unaffected by the influence of other departments and pressures, allowing us to focus on the Family Law issues you are facing.
You will find useful information regarding the main issues we deal with below.
Where there are children involved our main goal, from the outset, is to ensure that their best interests are met.
Depending upon the reason(s) for your separation it is important that you both remain focused on what is best for the children, notwithstanding any ill-feeling between you.
That may be difficult if one person has been unfaithful or behaved in a way which you could no longer tolerate.
It will be even more difficult if there has been domestic violence which has had an effect on the children.
We offer a fixed fee service for undefended adoptions of 1,500 + VAT.
There is a court outlay of 96.
The majority of these types of cases arise when one of the natural parents has a child/children from a previous relationship and marries.
The new spouse (who is the step-parent) then wants to adopt the child to form a family unit.
Any adoption will require attempts being made to locate the other birth parent, irrespective of whether or not they are named on the Birth Certificate or have seen the child/children for a number of years.
If Residence is not in dispute the question of the non-residents parents contact arrangements needs to be dealt with.
Again, if this cannot be achieved by agreement, mediation or negotiation the court would decide what the arrangements should be.
Failure to follow what the court has ordered can result in serious repercussions and possible criminal proceedings for contempt of court.
As with the question of Residence, the court, and you in particular, should consider matters from the children's point of view.
Residence is governed by Section 11 (2) the Children (Scotland) Act 1995.
You may well manage to agree who the child/children should reside with and who should exercise regular contact with them.
There are no set rules for who should be awarded residence of the children.
If you cannot agree then the courts consider what they think is in the child/children's best interests, and grant a Residence Order in favour of, usually, one parent.
This in no way diminishes the role of the non-resident parent and does not permit the resident parent to dictate the care arrangements for the children thereafter.
