In 2011 Leeds Family Law Ltd was established to serve the needs of those experiencing family issues in West Yorkshire and neighbouring Counties.
There is a common belief between many couples that if they live together, or have lived together for a number of years they automatically acquire similar rights as to those of a married couple.
The reality is that upon separation many find that they have no legal protection at all.
In the UK there are many couples that are choosing to live together and have done so successfully for many years without marriage.
The issues that unravel themselves if this couple separate can include rights in relation to their home, children, financial entitlements, entitlements to benefits, inheritance tax implications, pensions and next of kin issues.
By far the most sensitive area in any relationship breakdown is dealing with the children.
Often although there may be agreement as to where they may live, how often they should have contact with the parent with whom they are not living with can be an issue.
It is important to understand that where possible children benefit from having positive relationships with both parents.
We can help you to negotiate terms of contact that are beneficial to all concerned.
If there is the imminent threat that one parent may attempt to remove the child from the other or from the school, we can assist by advising you on emergency protection that can be taken to prevent this.
Collaborative Law is a relatively new way in which separating couples can deal with their divorce.
Each party will meet their own respective Lawyers and discuss the issues that are important to them in the usual manner.
Then the Solicitors, you and your spouse engage in a meeting known as a 4 way meeting to discuss the issues of the case.
These issues will include Children, Financial and Divorce matters.
There are at least 4-6 meetings that take place dependent upon the complexity of the case.
All issues relating to the breakdown of the marriage are resolved at these 4 way meetings.
Our Specialist Resolution Accredited solicitor has recognised expertise in the area of finances on divorce or separation.
Dealing with the finances will include dealing with the family home, the financial assets between the parties and any child or spousal maintenance.
It is the common belief that once you are divorced that neither party can make a financial claim on the other.
This is completely untrue.
Until such time that you resolve the financial matters on your divorce all potential financial claims that either spouse can make against the other will remain open.
