Services
We have assisted clients with their litigation and dispute resolution for nearly 20 years.
We have a strong expertise in most types of litigation, including bankruptcy & insolvency, professional negligence and construction disputes.
We have been repeatedly ranked in the legal directories as leaders in bankruptcy and insolvency defence and restructuring work, helping bankrupts, their spouses and company directors in need of expert and urgent advice to defend bankruptcy & insolvency claims, defend bankruptcy and winding up petitions, annul bankruptcy orders and safeguard assets.
We can help you if you are at threat of being made bankrupt or if you have been made bankrupt, being leading bankruptcy defence expert solicitors.
We do not act for trustees in bankruptcy, administrators or liquidators, i.e. insolvency practitioners to give you peace of mind that there is no conflict of interests.
This is our USP.
Most bankruptcy and insolvency solicitors do.
We have been ranked in the leading directories for this area of work - having been described as "relentless in achieving the best outcome for clients".
We provide expert Bankruptcy advice.
We help clients either defend bankruptcy petitions or if post bankruptcy, annul (cancel) bankruptcy orders.
We also defend claims brought by trustees in bankruptcy, particularly against the family home.
We can make an urgent application to the Court to prevent a Trustee in Bankruptcy being appointed to prevent him racking up significant costs.
If an annulment is obtained, the person is seen never to have been made bankrupt as the annulment completely wipes out the bankruptcy.
We can help you if you are at threat of being declared bankrupt as we are experts in defending bankruptcy.
We specialise in defending bankruptcy petitions, a large number of which are presented by the HMRC.
If you do not respond to a statutory demand the creditor may serve you with a bankruptcy petition.
A bankruptcy petition must be served on you by hand, i.e. personal service and you must be given 14 days' notice of the bankruptcy hearing.
If you do not pay or secure the debt within 21 days, then your creditor can present a bankruptcy petition against you to bankrupt you.
We can help you enter into time to pay arrangements with HMRC.
We work in partnership with specialist, tried and tested accountants to challenge and dispute HMRC tax bills to bring down the amount being claimed and buy you time.
You should be careful to enter into a settlement as quickly as possible as most people release equity from their properties to pay outstanding tax bills.
This however will not be possible once a bankruptcy petition has been issued as this triggers entries at the Land Registry preventing you from dealing with your properties and releasing equity or re-mortgaging.
